You can adjust your communication preferences by contacting Lokai via e-mail at privacy@mylokai.com.

  1. How Do We Protect Your Information?

Lokai has implemented commercially reasonable physical, technical, and administrative controls and procedures to protect the information that we collect. Unfortunately, no method of storage or transmission over the Internet can be 100% secure, and so we cannot guarantee that your information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. This provision does not apply to information that we collect automatically from your device or browser, as described in Section 1, above.

  1. Your Rights Under Data Protection Law (If You Are Based in the EU)

If you have created an account with us, you can sign into your account to access and update your information. You can manage your marketing preferences at any time via your account.

You have a right to ask us to confirm whether we are processing information about you and to request access to this information (‘right of access’). You also have the right to be informed of the safeguards we have in place relating to any transfers of your information to another country.

You may ask us, or we may ask you, to rectify information you or we think is inaccurate, and you may also ask us to remove information which is inaccurate or complete information which is incomplete (‘right to rectification’). If you inform us that your personal data is inaccurate, we will inform relevant third parties with whom we have shared your data so they may update their own records.

We want to ensure that your personal information is accurate and up to date. If any of the information that you have provided us with changes, for example if you change your email address, name, payment details, or if you wish to cancel your registration, please let us know using the contact details at the end of this policy.

You have a right to obtain your personal data from us and reuse it for your own purposes, perhaps for another service, without hindering the usability of the data (‘right of portability’). You have a right to seek the erasure of your data (often referred to as the ‘right to be forgotten’). You may wish to exercise this right for any reason, for example where it is no longer necessary for us to continue holding or processing your personal data you may withdraw your consent. You should note that we are entitled to and reserve the right to retain your data for statistical purposes. This right is not absolute, as we may need to continue processing this information, for example, to comply with our legal obligations, or for reasons of public interest.

You have a right to ask us to restrict our processing of your information (‘right to restriction’) if: • you contest its accuracy and we need to verify whether it is accurate • the processing is unlawful and you ask us to restrict use of it instead of erasing it • we no longer need the information for the purpose of processing, but you need it to establish or defend legal claims • you have objected to processing of your information being necessary for the performance of a task carried out in the public interest, or for the purposes of our legitimate interests. The restriction would apply while we carry out a balancing act between your rights and our legitimate interests. • you exercise your right to restrict processing, we would still need to process your information for the purpose of exercising or defending legal claims, protecting the rights of another person or for public interest reasons.

You have a right to prevent us from processing your data for the purposes of marketing.

If you would like to exercise any of your rights above, please let us know using the contact details at the end of this policy. We will act in accordance with your instructions as soon as reasonably possible and there will be no charge.

You have a right to report any of your concerns about our use of your data to the relevant data protection authority in your EU country.

  1. How Do We Respond To “Do Not Track?"

At present, there is no standard or agreement on how to respond to “do-not-track” signals that may be sent by web browsers. Accordingly, Lokai currently does not take any action in response to these signals. We may reassess how to respond to these signals if and when a final standard is established and accepted. In the meantime, you can opt out of many advertisers’ use of cookies to tailor advertising to you by visiting http://www.aboutads.info/choices/.

  1. How Do We Protect Children’s Privacy?

Lokai does not sell products for purchase by children. The Site and Services are not intended for anyone under the age of 18, and especially not for children younger than 13. If you are under the age of 18, you may not use the Site except with the permission or involvement of your parent or guardian. If we learn that we have collected any personal information from a child under the age of 13 without verification of parental consent, we will delete that information from our database as quickly as possible.

If you are based in the European Union, the above provisions relating to children’s privacy generally apply to children under the age of 16, but this may vary across different member states.

  1. How May We Change This Privacy Statement?

Lokai reserves the right to change this Privacy Statement at any time. Any such changes will be posted on this page. If we make a significant or material change in the way we use your personal information, the change will be posted on this page thirty (30) days prior to taking effect and registered users will be notified via e-mail. We may also post a notice on our Site. If you access or use the Site or Services after the effective date of the change, you agree to be bound by the updated Privacy Statement.

Lokai does not sell personal information. If Lokai were to sell personal information, it would act as follows: If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by emailing us at privacy@mylokai.com.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back into personal information sales at any time by emailing us at privacy@mylokai.com.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
